HOME STUDIO

Your Home Studio is the Fitaz Health PTY LTD studio located at 101 Main Street, Kangaroo Point, 4169, QLD, which you initially joined. Home club membership only allows you access to your home club.

MEMBERSHIP ENTITLEMENTS

Membership at Fitaz Health PTY LTD entitles you to:

  • Participate in normally scheduled classes as many times as you wish in a given period, subject to any restrictions in your membership type.
  • Additional fees may apply for specific programs or challenges.
  • Use of exercise equipment located on the gym floor and cardiovascular training areas.
  • Variations in facilities and services may apply based on your specific membership. Refer to your contract or speak to club management for details.

MEMBER’S RIGHT TO CANCEL

  • Cancel your membership after completing the minimum term stated in your contract by providing a paid and active 28 days notice.
  • Set your membership to finish at the end of your minimum term by providing notice of intent at least 28 days prior to the end of your contract.
  • All payments within the 28 days notice period must be finalized in full.
  • Membership continues on a month-to-month basis after the minimum term until written notice is given.

OTHER WAYS THAT A MEMBERSHIP CAN END

  • Fitaz Health PTY LTD makes adverse changes to this agreement.
  • Entitled to cancel under consumer legislation.
  • Medical incapacity.
  • Transferring membership with applicable fees and notice periods.

YOU CAN CANCEL FOR MEDICAL REASONS

  • Request cancellation within the minimum term due to medical reasons.
  • Provide a medical certificate.
  • Subject to Fitaz Health PTY LTD's reasonable satisfaction..

TRANSFER MEMBERSHIP TO ANOTHER PERSON

  • Consideration for 6 and 12-month agreements.
  • Transfer subject to reasonable eligibility conditions.
  • No cancellation fee if transferred to a non-member paying the administration fee.
  • Non-transferable to a past Fitaz Health PTY LTD member until 3 months of non-membership.

TRANSFERRING A PRE-PAID MEMBERSHIP TO ANOTHER PERSON

  • Transfer pre-paid membership with a $99 administration fee.
  • Non-transferable to a past Fitaz Health PTY LTD member until 3 months of non-membership.

TRANSFER MEMBERSHIP TO ANOTHER FITAZ HEALTH PTY LTD STUDIO

  • Transfer to another Fitaz Health PTY LTD studio subject to reasonable eligibility conditions.
  • No cancellation fee if transferred with a $99 administration fee.
  • Subject to the receiving studio's price points and minimum term periods.

IF YOUR MEMBERSHIP IS NO LONGER CONVENIENT

  • Request to end your membership during the Minimum Term in writing.
  • Fees include administration fee, membership fees, outstanding fees, 30 days notice period, and a cancellation fee (50% of remaining fees after 30 days notice).

WHEN CAN FITAZ HEALTH PTY LTD END YOUR MEMBERSHIP

  • Terminate membership for failure to abide by conditions, obligations, inappropriate conduct, club closure, or to protect health and safety.

SPECIAL CONDITIONS

  • Any special conditions or benefits will be attached to your membership agreement.
  • Free Time entitlement exempts weekly fees during specified periods.

MINIMUM TERM

  • Minimum Term is specified in the membership plan is a legally binding obligation.
  • All memberships subject to administration and joining fees unless otherwise specified.
  • Failure to pay when due requires immediate payment.
  • All memberships are ongoing agreements.

Flexi Membership - minimum of 4 Weekly or 2 Fortnightly Payments
6 Month Membership - minimum of 26 Weekly or 13 Fortnightly Payments
12 Month Membership - minimum of 52 Weekly or 26 Fortnightly Payments

MEMBERSHIP FREEZE

  • Freeze membership for a maximum of 12 weeks annually at $5 per fortnight.
  • Freeze entitlements subject to limits.
  • You cannot cancel your membership during the “freeze” period, and all membership freezes do not count towards the minimum term period. Freeze limits per annum apply.

OVERDUE FEES AND REVOCATION OF MEMBERSHIP ENTITLEMENTS

  • Membership fees debited fortnightly.
  • Right to recover debt before the next scheduled debit.
  • Right to revoke access for members in arrears.

MEMBERSHIP FEE INCREASE

  • Fees may increase yearly post minimum term.
  • Minimum notice of 2 weeks prior to any change.

PHYSICAL CONDITION AND NO MEDICAL ADVICE

  • Represent good physical condition with no undisclosed medical reasons.
  • Fitaz Health PTY LTD does not provide medical advice.
  • Pregnant women, children, elderly, or those predisposed to bleeding advised against heated exercise.
  • Advise Studio Owner of any change in health status.

DAMAGED, LOST OR STOLEN PROPERTY

  • Sole responsibility for damage caused willfully or negligently.
  • Fitaz Health PTY LTD not responsible for personal property damage, loss, or theft.

USE OF OTHER FITAZ HEALTH PTY LTD STUDIOS

  • Home membership allows access to the home studio only.
  • All Club Access memberships cover all studios open at sign-up.
  • Additional services/extensions may incur upgrade costs.

ASSUMPTION OF RISK OF INJURY AND WAIVER OF CLAIMS

  • Assume all risks of injury and waive rights to pursue money damages.
  • Hold harmless Fitaz Health PTY LTD for injuries while on Fitaz Health property or during events.
  • Waiver applies to family members, successors, heirs, and assigns.

DISCLOSURE OF YOUR PHYSICAL CONDITION

  • Disclose relevant health and fitness information.
  • Discuss health concerns with a doctor before participating.
  • Advise of any changes in health status.

MINIMUM AGE

  • Membership holders must be a minimum of 14 years of age.
  • Minors under 18 require a parent or guardian co-sign and health form completion.

PERSONAL EMAIL ADDRESS

  • Provide a personal email address as a primary contact method.
  • Option to opt-out from receiving updates.

PRIVACY STATEMENT, THE FITAZ HEALTH PRIVACY POLICY

  • Fitaz Health PTY LTD will protect personal information in accordance with its Privacy Policy.
  • Video monitoring may be used for health, safety, and security.

PROMOTIONS

  • Promotional offers are subject to defined periods and locations.
  • Non-transferable and applicable only to specified offerings.

PLEASE KEEP CONTACT DETAILS UP TO DATE

  • Notify Fitaz Health PTY LTD promptly of any changes to personal information.

IN-STUDIO FILMING, PHOTOGRAPHY & CCTV

  • Consent to filming and photography for promotional purposes.
  • Acknowledge the use of CCTV for safety and security.

DIRECT DEBIT SERVICE AGREEMENT

  • Governs the terms and conditions of the direct debit payment service.
  • Utilizes third-party billing company (currently EziDebit).
  • Fitaz Health PTY LTD reserves the right to change the billing company.
  • Debits processed by the designated billing company.
  • Fees and payments for DD Membership and Upfront Membership.

FITAZ HEALTH INBODY TERMS & CONDITIONS

  • Comply with Body Composition Analysis & Inbody Protocol.
  • Make a booking for all Inbody Scans.
  • Inbody Scans during specified hours only.
  • Inbody Scans non-transferable.
  • Failure to attend may result in loss of service.

MEMBERSHIP REFERRAL PROGRAM TERMS & CONDITIONS

  • Referral program allows Fitaz Health members to refer friends.
  • Rewards for Referrers in the form of credits.
  • Program subject to changes, termination, or suspension.
  • Referrals through unique referral link or other specified means.
  • Referral made without the link not eligible.

STAFFED AND UNSTAFFED HOURS

  • Staffed hours posted on the club's website.
  • Use facilities at your own risk during all hours.

ACCESS BY NON-MEMBERS

  • Only members have access to the Club.
  • Prohibited from bringing non-members into the Club.
  • Breach results in fines, membership termination, and prohibition from joining other Fitaz Health Clubs.
  • Granting access to a non member will result in a $150 imposed for violations, with repeat offenders facing membership termination and a national ban.

YOUR CONDUCT AND USE OF THIS CLUB

  • Expected proper and civil conduct.
  • Appropriate attire required.
  • Member responsible for damage due to negligence.
  • Exercise discretion during late hours.
  • Avoid disturbances or loud noises.
  • Commercial activities prohibited without written permission.
  • Prohibition or restriction of membership for improper conduct.

By signing this Agreement or engaging in a membership contract with Fitaz Health, the Member acknowledges consent and acceptance of the terms outlined herein. Fitaz Health reserves the right to amend this Agreement with prior notice at its discretion. This Agreement is governed by the laws of Queensland, Australia, and any disputes subject to the non-exclusive jurisdiction of the courts of Queensland, Australia.
